Independent Contractor Policy for Affiliates

  1. Introduction:
    • As independent contractors representing our company, affiliates play a crucial role in driving sales, managing client relationships, and maintaining the integrity of our business. This policy outlines the expectations and guidelines for affiliates to ensure ethical conduct, responsibility, and respect in their operations.
  2. Independent Contractor Status:
    • Affiliates acknowledge and agree that they are independent contractors and not employees of the company. As independent contractors, affiliates are responsible for managing their own schedules, expenses, and tax obligations.
    • Affiliates understand that they will not receive employee benefits such as health insurance, retirement plans, or paid time off, and are solely responsible for providing their own insurance coverage and benefits.
  3. 1099 Tax Reporting:
    • Affiliates will receive a Form 1099-MISC from the company at the end of each tax year, reporting any income earned as an independent contractor. It is the responsibility of affiliates to accurately report this income on their personal tax returns and pay any applicable taxes.
    • Affiliates should consult with a tax professional to ensure compliance with tax laws and regulations, including deductions, expenses, and record-keeping requirements associated with independent contractor status.
  4. Training Requirements:
    • Before affiliate status is enabled, affiliates are required to complete all assigned training modules and assessments provided by the company. This includes training on products and services, sales techniques, client relationship management, and compliance with company policies and procedures.
    • Affiliates must demonstrate proficiency in the required training materials and pass all assessments with a satisfactory score before they can commence their affiliate activities.
  5. Affiliate Role:
    • Upon completion of training, affiliates will be allowed to begin the affiliate role. The success of the affiliate is determined by the affiliates determination and motivation to provide the services and expand the company’s network of host locations and advertising clients for each host network.
    • Affiliates are expected to begin their affiliate role promptly and professionally, adhering to deadlines and quality standards set by the company. 
    • In the event the affiliate does not sign up host locations or retain monthly or annual advertising agreements for the company over a 3 month period, it is the company’s right to pause or terminate the affiliate’s account.  Any future commissions will not be awarded to former affiliate including any child affiliate commissions earned by the affiliates child affiliates moving forward.  This is included in the commission policy also.
  6. Client Interaction Guidelines:
    • When interacting with clients, affiliates must maintain a professional demeanor and focus on the client’s needs and concerns.
    • Affiliates are prohibited from using their phones for personal purposes, including texting, using apps, or browsing the internet, while engaging with clients unless it is directly related to showcasing company products or services or signing up a business.
  7. Ethical Conduct:
    • Affiliates must conduct themselves with the highest level of ethics and integrity in all interactions with clients, prospects, and fellow team members.
    • Affiliates must refrain from engaging in deceptive or unethical practices, including misrepresentation of products or services, false promises, or unethical sales tactics.
  8. Responsibility and Accountability:
    • Affiliates are responsible for meeting sales targets, managing client accounts effectively, and providing exceptional customer service.
    • Affiliates must maintain accurate records of sales activities, client communications, and performance metrics, and provide regular updates to the company as required.
  9. Client Relationship Management:
    • Affiliates must prioritize building and nurturing positive relationships with clients, understanding their needs, and providing solutions that add value to their business.
    • Affiliates should proactively communicate with clients, addressing any concerns or issues promptly and professionally, and seeking feedback to continuously improve service delivery.
  10. Respect and Professionalism:
    • Affiliates must treat clients, prospects, and fellow team members with respect and professionalism at all times, regardless of differences in opinion or background.
    • Affiliates should refrain from engaging in discriminatory behavior, harassment, or disrespectful communication in any form.
  11. Compliance with Laws and Regulations:
    • Affiliates must comply with all applicable laws, regulations, and industry standards related to sales, advertising, data privacy, and consumer protection.
    • Affiliates should stay informed about relevant legal requirements and proactively seek guidance from the company if unsure about compliance issues.
  12. Confidentiality and Data Security:
    • Affiliates must handle confidential client information and company data with the utmost care and respect for privacy.
    • Affiliates should not disclose sensitive information to unauthorized parties and must follow established protocols for data protection and security.
  13. Continuous Training and Development:
    • Affiliates are required to participate in ongoing training and development activities as assigned by the company. This may include refresher courses, updates on product offerings, changes in industry regulations, or new sales techniques.
    • Affiliates should proactively seek opportunities for learning and improvement to enhance their skills and knowledge in their role.
  14. Termination of Contract:
    • The company reserves the right to terminate the contract of any affiliate found to be in violation of this policy or engaging in behavior detrimental to the company’s reputation or interests.
    • Affiliates may also choose to terminate their contract with prior notice to the company if they are unable to meet their obligations or wish to pursue other opportunities.
  15. Policy Acknowledgment:
    • By accepting the terms of this policy, affiliates acknowledge their understanding of and agreement to abide by the expectations and guidelines outlined herein.

This policy serves to establish clear expectations for affiliates as independent contractors representing our company, ensuring adherence to ethical standards, responsibility, respect, and professionalism in all aspects of their operations, including client interactions, and prohibits the use of personal phones for non-business purposes during client engagements.
